An Ordinance to create Sections 1.12 and 12.06(3)(h), and to rescind and delete Sections 11.10(6) and 13.06(5)(a) and (b), and to renumber Section 13.06(5)(c) of the Municipal Code of the Village of Ellsworth.

Section 1. Section 1.12 is hereby created to read as follow:

"1.12 RETURNED PAYMENT CHARGE., Any check issued to or for the benefit of the Village of Ellsworth, or any of it's departments, for services, fines, taxes, assessments or any other charge of any kind or nature whatsoever, which are returned "Not Sufficient Funds" (NSF), "Account Closed" or otherwise in such manner that the check or remittance does not constitute good funds, shall result in a surcharge in an amount as is established from time to time by resolution of the Village Board and set forth in the Village Fee Schedule. Such surcharge shall be added to the charge with respect to which the check, draft or remittance was issued."

Section 2. Section 12.06(3)(h) is hereby created to read as follows:

"(h) Class "B" Picnic or Special Events Licenses"

Delete wording "All such fees are per year, except those for licenses under (c).

Section 3. Sections 11.10(6) and 13.06(5)(a)(b) are hereby rescinded and deleted from the Ordinance.

Section 4. Section 13.06(5) is hereby retitled "Liens For Unpaid Water And Sewer Charges."

Section 5. Section 13.06(5)(c) is hereby renumbered Section 13.06(5).

Section 6. This Ordinance shall take effect upon passage and publication.
