WI DNR: Public Notice - Fetzer Farms Inc. Permit

Facility Where Discharge Occurs: Fetzer Farms Inc, SEQ NEQ Sec 36 T26N R16W, Town of El Paso, Pierce County, Wisconsin
Receiving Water and Location: Surface water and groundwater within the Rush River and Plum Creek Watersheds of the Chippewa River Basin
Brief Facility Description: Fetzer Farms Inc. is a currently permitted Concentrated Animal Feeding Operation (CAFO). Fetzer Farms Inc. is owned and operated by Paul Fetzer. It currently has 2200 animal units. There may be a general increase to approximately 2500 AU during the permit period. Fetzer Farms Inc. has a total of 1400 acres available for land application of manure and process wastewater. Of this acreage, 1000 acres are owned and 400 acres are rented.
The operation’s current WPDES permit WI-006194-02-0 expires on December 31, 2013 and the Department has proposed to cover Fetzer Farms Inc. under the Large Dairy CAFO WPDES General Permit WI-0063274-01.
The operation consists of the following sites and sample points:

•S002C - Liquid Storage #3 - 2008 Earthen, Synthetically Lined Pit
(Total Storage = 16 Million Gallons)
•S003A – Milking Center Waste Storage #1
No specific new construction plans have been submitted.
The Department has tentatively decided that the above operation should be covered under the Large Dairy CAFO WPDES General Permit No. WI-0063274-01-0. In accordance with ch. NR 150, Wis. Adm. Code, coverage under a WPDES general permit is a type IV action and does not require completion of an Environmental Assessment. An Environmental Assessment has previously been certified for the issuance of the Large Dairy CAFO WPDES General Permit.

Persons wishing to comment on or object to the proposed permit action, the terms of the nutrient management plan, or the application, or to request a public informational hearing under subchapter II of ch. NR 203, Wis. Adm. Code, may write to the Department of Natural Resources at the permit drafter’s address. All comments or suggestions received no later than 30 days after the publication date of this public notice will be considered along with other information on file in making a final decision regarding the permit. Anyone providing comments in response to this public notice will receive a notification of the Department’s final decision regarding permit coverage. Where designated as a reviewable surface water discharge permit, the U.S. Environmental Protection Agency is allowed up to 90 days to submit comments or objections regarding this permit determination. If no comments are received on the proposed decision to grant coverage or the nutrient management plan from anyone, including U.S. EPA, permit coverage will be granted and the terms of the nutrient management plan will be incorporated into the general permit as proposed for this operation.
Pursuant to Section 2 of the General Permit and ch. NR 203, Wis. Adm. Code, the Department may schedule a public informational hearing if within 30 days of the public date of this notice, a request for a hearing is filed by any person. The Department shall schedule a public informational hearing if a petition requesting a hearing is received from USEPA or from 5 or more persons or if the Department determines there is significant public interest. Requests for a public informational hearing shall state the following: the name and address of the person(s) requesting the hearing; the interest in the proposed permit of the person(s) requesting the hearing; the reasons for the request; and the issues proposed to be considered at the hearing.
Information on file for this permit action, including the operation’s nutrient management plan and application may be inspected and copied at the permit drafter’s office, Monday through Friday (except holidays), between 9:00 a.m. and 3:30 p.m. Please call the permit drafter for directions to their office location, if necessary.
