PUBLIC NOTICE: Wisconsin Industrial Sand Co. - Proposed Artificial Waterbody

Notice of Pending Application for Proposed
Artificial Waterbody - No Navigable Connection
Al Nelson, W3302 Hwy 35 South, Malden Rock, Wl 54750 has applied to the Department of Natural Resources for a permit to Construct a Waterway that connects with Lake Pepin.
The project is located in the NW1/4 of the NE1/4 of Section 22, Township 24 North, Range 16 West, Village of Maiden Rock, Pierce County.
The Wisconsin Industrial Sand Co. site currently includes compacted sand haul roads for its mining operations, originally established over 80 years ago. The exposed sand haul road and surrounding steep sandy slopes contribute to total suspended solids ("TSS”) loading at the Site. The proposed project is to pave the haul road and vegetate the sandy slopes as much as practicable to reduce the TSS loading.
In paving the haul road, the Site\'s total runoff quantity will be slightly increased (the existing haul road has been compacted for several years and has an effective curve number closer to that of pavement rather than otherwise typical sandy soils). To address the additional stormwater runoff, an existing stormwater detention basin (“Pond A”) will be expanded and an additional basin (“Pond B”) will be installed. Both ponds will be equipped with filtered and perforated underdrains to promote settling of suspended solids, infiltration, and emptying of the pond for additional storm events and maintenance activities. Both ponds will include concrete pre-cast outlet structures with armored discharge routing to protect down-gradient slopes and drainages from erosion. The ponds are located within 35 feet of the waterway. Bank erosion control will include hard rip rap with vegetated cover where necessary. Water way has been determined to be navigable at lower end of the site.
The Department will review the proposal provided by the applicant and any information from public comments and a public informational hearing, if requested. The Department will determine whether the proposal complies with ss. 1.11 and 30.19(4), Stats., and ch. NR 150, Wis. Adm. Code, and ensure that the required mitigation meets the standards in s. 281.36(3r), Stats. if the project impacts wetlands.
The Department has made a tentative determination that it will issue the permit or contract for the proposed activity.

A request for hearing must include the docket number or applicant name and specify the issues that the party desires to be addressed at the informational hearing.
lf no hearing is requested, the Department may issue its decision without a hearing. If a public informational hearing is held, comments must be postmarked no later than 10 days following the date on which the hearing is completed.
The final decision may be appealed as indicated in the decision document.
