A former area resident was placed on three years probation and was also given three years deferred prosecution for sexual assault of a child.


Mark Holmquist, 18, who now lives in Spooner, pled guilty Friday in Pierce County Circuit Court to two misdemeanor counts of fourth degree sexual assault and was given probation. He was placed on deferred prosecution for a second degree sexual assault of child, which is a felony.

The charges stem from a November incident, according to the criminal complaint. A-then- 13-year-old girl told River Falls police she had sex with an 18-year-old boy within city limits. When police asked if the boy thought the girl was 18, the girl adamantly denied that, saying there was no way she could pass for 18.

When police asked about Holmquist, she grew silent because she was fearful Holmquist would get in trouble because it was already discussed Holmquist was there.

The girl said the sex was consensual and unprotected, and that she wasn't concerned about getting pregnant because, if she were to get pregnant, she would have an abortion.

When interviewed by River Falls police a second time in December, the girl admitted the boy in question was Holmquist, the two had been dating for about a month and they had intercourse approximately seven times during that span. She said two of those times occurred within city limits, with the other five occurring at an unknown address.

The girl added she was never intoxicated or impaired while they were having intercourse.

"He holds the key to his future," District Attorney John O'Boyle said in explaining the agreement. "If he screws up, he's looking at a felony conviction."

O'Boyle said the most concerning part about the incident was the age difference because there were five years between the two.

"With that age gap, it wasn't a level playing field," he said.

Other conditions of the probation agreement include payment of all court costs, no contact with the victim or any females under 17 and entering a sex offender program at the discretion of his probation agent.
