PLEASE TAKE NOTICE that by virtue of a judgment of foreclosure entered on July 26, 2013, in the amount of $117,958.31, the Sheriff will sell the described premises at public auction as follows:
TIME: January 28, 2014, at 9:00 o\'clock a.m.
TERMS: 1. 10% down in cash or certified funds at the time of sale; balance due within 10 days of confirmation of sale; failure to pay balance due will result in forfeit of deposit to plaintiff.
2. Sold “as is” and subject to all legal liens and encumbrances.

DESCRIPTION: A parcel of land located in Government Lot Two (2) in Section Nine (9), in Township Twenty-four (24) North, Range Seventeen (17) West, in the Village of Bay City, more fully described as follows: Commencing at a point 150.47 feet South and 231.58 feet East of the Northwest corner of said Government Lot 2, which point is also the Southwest corner of Lot 1 of Lakeview Addition to the Village of Bay City, and the point of beginning; thence South 4° 30’ East along the East line of C.T.H. “EE” a distance of 342 feet; thence North 85° 37’ East a distance of 137 feet; thence South 4° 30’ East a distance of 74 feet to the North line of Highway 35; thence North 85° 37’ East along said North line of Highway 35 a distance of 137 feet; thence North 6° 18’ West a distance of 430 feet to the South line of Lakeview Addition to the Village of Bay City; thence South 82° 30’ West along said South line of Lakeview Addition a distance of 261 feet to the point of beginning. Except from parcel the North 100 feet of said parcel as more fully described in Vol. 37 of Rec. page 261.
Subject to perpetual appurtenant easements for ingress, egress and utility purposes, reserved by grantor for the benefit of himself, his heirs and assigns, described as follows: Easement No. 1: An easement over the existing driveway Commencing on the South line of said premises and extending Northerly a distance of 100 feet, more or less to the terminus of the existing driveway.
Easement No. 2: An easement 20 feet in width commencing at the Northerly terminus of Easement No. 1 and extending in a Northeasterly direction to the Easterly line of the above parcel.
Such description is also intended to include any additions thereto by reason of the vacation of any alley or street lying adjacent to said parcel.
