Alan J. Sukowatey, 66, W3162 650th Ave., will be sentenced Monday, April 14, for felony theft in a business setting up to $5,000.

According to the criminal complaint:

Pierce County sheriff’s investigators were notified last April Sukowatey, acting as a trustee for the Herman Sukowatey Trust, deposited a $75,000 check from the Internal Revenue Service in August 2012. The problem is Sukowatey was no longer trustee; he was in that position from 2008-2010.

Bank records indicate the check was deposited into the AJS Development account and transferred out several weeks later to a Minnesota business.

Sukowatey told the current trustee in an e-mail he would return the funds last summer. He refused to answer messages from investigators while the investigation was ongoing.

He was officially charged last July with felony theft greater than $10,000, but pled down to the lesser charge as part of the agreement.
