State Supreme Court deadlocked on Galeman's involvement in case
MADISON - The state Supreme Court is deadlocked on whether Justice Michael Gableman should hear an appeal from a convicted armed robber.
A 3-3 vote means Gableman will hear the case. The case of Aaron Antonio Allen is one of a string of cases that defense attorneys have asked Gableman to recuse himself from.
The attorneys claim Gableman made it clear during his campaign that he will rule against criminals and for prosecutors, and is therefore biased -- but Justices Patience Roggensack, Annette Ziegler and David Prosser say the high court doesn't have the authority to tell a fellow Justice when to step aside from a case.
