The purpose of this ordinance is to establish all-terrain vehicle (ATV) routes in the Town of Spring Lake and to regulate the operation of ATV’s in the Town of Spring Lake. The full text of this ordinance may be viewed at the Spring Lake Town Hall by contacting the Town Clerk at (715) 772-4228.
The Town Board of the Town of Spring Lake, Pierce County, Wisconsin has the specific authority to adopt this All-Terrain Vehicle Route Ordinance under s 23.33 (8) (b) and (11), Wis. Stats. Operation of ATV’s shall be subject to all provision of s.23.33, Wis. Stats
No person may operate an ATV on the roadway portion of any highway in the town except on roadways that are designated as ATV routes by this ordinance. Operation of ATV’s on a roadway in the town that is an ATV route is authorized only for the extreme right side of the roadway except that left turns may be made from any part of the roadway that is safe given prevailing conditions. On paved roadway ATV’s must be operated on the paved portion of the roadway and not on the gravel shoulder.
The following routes are designated ATV routes in the Town of Spring Lake: all roads in Town of Spring Lake.
In addition to the provisions of s.23.33, Wis. Stats, the following restrictions are placed on the use of the town ATV routes designated by this ordinance: all ATV operators shall observe a speed limit of not more than 40 mph or the posted roadway speed limit (whichever is lower); all ATV operators shall ride single file; the allowed hours of operation shall be from 6:00 a.m. to 8:00 p.m. during Daylight Savings Time and from 6:00 a.m. to 7:00 p.m. during Standard Time; if you are under age 12, you cannot operate an ATV on a road or route under any circumstances; no person who is at least 12 years of age and who is born on or after January 1, 1988, may operate an all-terrain vehicle unless he or she holds a valid safety certificate; all ATV operators 12 to 15 must be under the direct supervision of a parent or legal guardian at all times when operating on a designated ATV route; all persons under 18 must wear a helmet.
This ordinance may be enforced by any law enforcement officer authorized to enforce the laws of the State of Wisconsin. The penalties under s.23.33 (13) (a), Wis. Stats, are adopted by reference.
This ordinance is effective when ATV route signs are posted by the Pierce County ATV club and and goes from October 1, 2008 to September 30, 2010 but can be discontinued at any time by the decision of the Spring Lake Town Board.
