ORDINANCE NO. 616
An ordinance to amend Sec. 9.12, 11.01, 11.02 and 12.10(4)(b)(3) and (4)(c).
WHEREAS, the Village Board may, from time to time, not have a specially designated Health Officer, using instead services of the Pierce County Department of Public Health, the Village Board deems it expedient and necessary to amend the foregoing sections.
NOW THEREFORE, the Village Board of the Village of Ellsworth does hereby ordain as follows:
Section 1. Sec. 9.12 is amended to delete the words "Health Officer" and substitute in place of those words the following: "Animal Warden/Humane Officer, or their designee in their absence".
Section 2. Sec. 11 .01 is retitled "Administration of Health and Sanitation Laws and Regulations."
Section 3. Sec. 11 .01 (1) is amended to delete the phrase "Board of Health of the Village" and substitute therefore the phrase "the Village Board".
Section 4. Sec. 11 .01 (2) is amended to delete the second sentence.
Section 5. Sec. 11 .01 (3) is created to read as follows:
"(3) Health Officer. Where the Village President or Village Board has not specifically designated or appointed a Health Officer, the Village President, and in his absence, the Chief of Police, shall serve as Health Officer. The Health Officer may rely upon directives and recommendations of the Pierce County Department of Public Health, and shall also assist in the enforcement of any Orders issued by such Department where such Department has jurisdiction in the Village."
Section 6. Sec. 11 .02(2) is amended to delete the words "by the Board of Health".
Section 7. Sec. 11 .03 is rescinded.
Section 8. Sec. 11 .04 is amended to delete the words "or the Board of Health".
Section 9. Sec. 12.10(4b3) is amended to change the words "A state health officer's certificate" to read: "A certificate from a State or Local Health Officer, or the Pierce County Department of Public Health".
Section 10. Sec. 12.10(4c) is amended to change the phrase "one year" to "one month".
Section 11. This Ordinance shall take effect upon passage and publication.
