RESOLUTION No. 2012-01

NSPW Natural Gas Service

WHEREAS, “Fetzer Farms” has requested Northern States Power Company, a Wisconsin corporation (“NSPW”), to provide natural gas service to its facilities located at N4365 Cty Rd CC, Elmwood, WI in the County of Pierce, State of Wisconsin; and

WHEREAS, in order to provide natural gas service to potential customers within the Town of El Paso (“Town”) boundaries NSPW is seeking approval from the Town to provide natural gas service within the Town boundaries pursuant to Wis. Stat. § 196.58; and

WHEREAS, in order to provide natural gas service within the Town boundaries NSPW is seeking permission to construct a gas main or mains including such fixtures, attachments, meters, and equipment as are necessary to construct, operate, and maintain a gas main or mains under, across, upon, along, and within the limits of any and all public highways and Town road right-of-way in the area defined in the map appended to this Resolution as Attachment A ; and

WHEREAS, the Town Board wishes to grant NSPW such approvals, authorizations, and permission as necessary to provide natural gas service within the Town boundaries.

NOW Therefore, Be It Resolved, that the Town Board does hereby approve, authorize and grant its permission, pursuant to its authority under Wis. Stat. §§ 196.58 and 86.16, for

NSPW to provide natural gas service within the Town boundaries, provided, however, that NSPW’s provision of natural gas service complies with the provisions of Wis. Stat. § 86.16 regarding the placement of facilities in public highway and Town road right-of-way; and

Be It Further Resolved, the Town hereby approves and authorizes NSPW, its successors or assigns to engage in the business of selling natural gas in the area defined in those areas of the Town shown on Attachment A; and

Be It Further Resolved, NSPW, its successors or assigns are hereby authorized to construct a gas main or mains including necessary fixtures, attachments, meters, and equipment to construct, operate, and maintain a gas main or mains under, across, upon, along, and within the limits of any and all public highways and Town road right-of-way within the Town boundaries; and

Be It Further Resolved, that NSPW, after constructing and/or maintaining natural gas facilities in public highway or Town road right-of-way shall restore such right-of-way as nearly as practicable to its original condition; and

Be It Further Resolved, NSPW is hereby authorized to include a copy of this executed resolution in its application before the Public Service Commission of Wisconsin for a certificate of authority to provide natural gas service to the Town of El Paso to indicate the Town’s support of NSPW’s application.

i Description of Attachment A per Trudy Popenhagen, Xcel Energy, 6/1/2012: The extension is 5,808ft from 390th Ave and CTY CC in Salem Twp and then in El Paso Twp. The gas 2" 100psi PE HD (high density) main will be installed 28ft west of centerline of CTY CC at 30 inches deep in the west ROW. Xcel will end this extension right at Fetzer farms. They want to get service to the corn dryer, home and mobile home.
