Sealed Bids for the construction of Sea Wing Park Improvements - Drainage & Access for the Town of Diamond Bluff in one contract, as follows:

Will be received by TEC Design, Inc. for the Town of Diamond Bluff, at the office of TEC Design, Inc., 5828 Arndt Lane, Eau Claire, WI 54701, by 10:00 am, local time, May 6, 2009 and then at said office publicly opened and read aloud.

All Bids shall be placed in an opaque envelope addressed to TEC DESIGN, INC., 5828 Arndt Lane, Eau Claire, WI 54701 and shall be labeled "Sea Wing Park Improvements- Drainage & Access" and incorporate the name and address of the Bidder on the outside of the envelope.

The bids shall be submitted on the forms furnished with the specifications and in accordance with the Instructions to Bidder. Each bid shall be accompanied by a certified check payable to the owner equal to five percent (5%) of the bid or a bid bond of a bonding company duly authorized to do business in the State of Wisconsin in an amount equal to five percent (5%) of the bid. This bid guarantee shall be subject to forfeiture as provided by law.

Disadvantaged Business Enterprise (DBE). It is the policy for this project that minority business enterprises, as defined by 49CFR Part 23, shall have maximum opportunity to participate in the performance of this contract. This project's goal for DBE participation is discretionary. Bidders are not required to utilize DBE's, but should attempt a good faith effort to utilize DBE's for this project.

Attention of bidders is particularly called to the requirements as to condition of employment to be observed and minimum wage rates to be paid under the contract, Section 3, Segregated Facility, Section 109 and E.O. 11246. Federal wage rates are applicable to this project per Federal Labor Standards Provisions (4010). Minimum salaries and fringes to be paid on the project shall be in accordance with the prevailing wage rate scale established by the Federal Department of Labor (DOL). Attention is called to the fact that not less than the minimum salaries and fringes set forth in the Contract Documents must be paid on this project, and that the Contract must ensure that employees and applications for employment are not discriminated against because of their race, color, religion, sex, national origin, or other protected class. Federal Labor standards program laws, including, but not limited to the Davis Bacon Act, the Copeland Anti Kickback Act, and the Contract Work Hours and Safety Standards Act will apply to all projects.

This project is funded, in part, through the Federal National Scenic Byways Program and Federal Aid for Sport Fishing Program.

This project requires that an affidavit of non-collusion be incorporated as part of the proposal requirements provided to each prospective bidder. Failure to complete the sworn statement will make the bid non-responsive and not eligible for award considerations.

The Bidding Documents may be examined at the Builders Exchange, Inc., 2228 N. Hillcrest Parkway, Altoona, WI 54720 or the office of TEC DESIGN, INC., 5828 Arndt Lane, Eau Claire, WI 54701.

Copies of the Bidding Documents may be obtained only from the issuing office, TEC DESIGN, INC. upon payment a $30 is non-refundable check made payable to TEC Design, Inc..

Bids shall not be withdrawn for a period of forty-five (45) days after the date of opening. The Town of Diamond Bluff reserves the right to reject any or all of the bids, to waive any irregularities, or to accent such bids as in the opinion of the Town of Diamond Bluff, will be in its best interest.
