Ellsworth man charged with repeated sexual assault of child

An Ellsworth man was charged Monday in Pierce County Circuit Court with repeated sexual assault of a child.

Dylan M. Berner, 20, 106 Evergreen Estates, is scheduled to make his initial court appearance at 10 a.m., Monday, Sept. 23.

The criminal complaint states:

In July, River Falls police were notified of the sexual assault that allegedly occurred during River Falls Days 2011.

The victim’s mother told police through therapy they deemed the issue was resolved, as it was determined the contact was consensual. Police said otherwise, as the victim was 13 at the time and Berner was 18 and, due to the age difference, it was still illegal.

The victim explained the two communicated by phone previously and met for the first time at the River Falls Days parade, held Friday night, and hung around the rest of the weekend. She remembered on that Saturday she was at her dad’s residence, outside of River Falls, and while he was at work, she had sexual contact and intercourse with Berner multiple times.

She added she spent Saturday and Sunday at a friend’s house, also in River Falls, and the alleged contact and intercourse continued there as well. She also told police, after awhile, she told Berner no as she was feeling “overwhelmed.” He said no, and she relented.
